Provisional Waivers for Certain Spouses, Children, and adult Sons and Daughters of U.S. Citizens

Earlier this year, DHS announced that it would allow certain  relatives of U.S. citizens who entered the U.S. without permission to apply for waivers of inadmissibility before leaving the U.S. and being possibly stuck outside of the country for up to ten years. The regulations have been proposed but not yet implemented. Contact the Office of Daniel E. Green and be placed on a contact list to be notified as to when this program is put into effect, and also visit uscis.gov daily to get the latest news on the procedure.

Centralization of Waiver Filing

As of June 4, 2012, USCIS centralized waiver filing in the U.S. This ends a long term problem that had existed previously, where foreign nationals would file waivers with various overseas USCIS offices, each with its own standards for waiver adjudication.  The centralization process should make waiver adjudication more consistent.  In addition, domestic filing of waivers will make it cheaper for my clients to file waivers, since domestic filing would cut down on expensive and sometimes unpredictable overseas courier service use.

Temporary Protected Status for Syrian Citizens

In March, DHS designated Syrian citizens in the U.S. as eligible for Temporary Protected Status due to the ongoing violence in the country.  Syrian citizens who were present in the U.S. on March 29 2012 and who have continuously resided in the U.S. since that date may apply for TPS status between March 29 and September 25 2012.  Contact the Office of Daniel E. Green to make further inquiries on eligibility, so as not to miss the application deadline.
